Terms of Use

These terms of use (the "Terms") regulates your use of Digantara's Flight Dynamics Services ("Services") through an application programming interface ("API"). Any reference to "we", "us", or "our" in these Terms means Digantara. Any reference to "you" means the user of the Services (the "User").

A unique API key has been generated for you to gain temporary access to the Services on a trial basis. The purpose of these Terms is to ensure that all Users have fair and equal access to the Services and prevent any abuse or misuse of the Services. These Terms are in addition to any other documents that you may have entered with us.

1. Scope

Your use of the Services constitutes your agreement to these Terms. We retain the right to modify these Terms, which will be effective once it is published publicly. In case you continue to use the Services following such modifications (with the last date of modification reflected on the top of this page), such use constitutes your acceptance of the modified Terms.

2. User restrictions

2.1 Obligations

As a User of the Services, you are obliged to ensure legitimate use of the Services for its intended purpose. We are entitled to determine the scope of activities that may amount to an "unreasonable use" of the Services, including, without limitation, any use which:

  1. is in breach of applicable laws, including those in relation to privacy, data, or spam;
  2. interferes with other users' access to, or use of, the Services;
  3. reduces our ability to fairly and equitably provide the Services to other Users;
  4. attempts to bypass or manipulate usage restrictions on the Services;
  5. results in restricted or disallowed content being disseminated through the Services; or
  6. involves reselling the Services, or sharing access to the Services, without our prior written consent.

2.2 Prohibited actions

As a User, you will neither attempt nor encourage others to:

  1. interfere with, disrupt, or disable any API features;
  2. use the API for purposes contrary to the Terms without our prior written consent; or
  3. sell, rent, lease, sub-license, redistribute, or syndicate the API or any data available on the API to any third party without our prior written consent.

3. Limited API calls

To maintain optimal performance of the API, the number of API calls/requests is limited. If we find that a User is exceeding these limits such that the Services provided to other Users is being adversely impacted, we will endeavour to find a mutually agreeable solution.

4. Consequences of material breach

If we deem your usage to be a material breach of these Terms, which is not cured within a reasonable period after we have notified you of the breach, we may immediately, without any liability to us:

  1. give you a warning that further repetition of the breaching activities may result in suspension or termination of the Services;
  2. suspend or limit the Services;
  3. implement technical mechanisms to prevent behaviour which breaches these Terms;
  4. report such conduct to applicable authorities; and/or
  5. take any other action we deem necessary, including actions to recover costs and expenses.

5. Notification for Collection and Use of Data

You are notified that by signing up for the Services, we are collecting the following data from you:

  1. Name;
  2. Organization Designation;
  3. Organization Name; and
  4. Organization Email ID

We are collecting this data to provide the Services to you. These details will be processed for the purpose of enabling the User to assess their interest in availing the Services as our potential customer. However, if you would like for any of the aforementioned data to be deleted, or if you would like to opt out of the Services, please contact us at support@digantara.co.in, or if you have any other concerns related to the details you have provided, you may contact Mr Rahul Rawat (Data Protection Officer) at rahul.rawat@digantara.co.in.

6. Support

For further information about these Terms or the practices that we follow to ensure compliance, or to communicate with us, please contact us at support@digantara.co.in. We may take steps to detect and prevent unreasonable use of the Services or breach of these Terms. If you believe the Services have been misused by a third party, have been barred as a result of an accident or error, please contact us at support@digantara.co.in.
